1. Overview

This website is operated by CustomFolk. Throughout the site, the terms "we", "us" and "our" refer to CustomFolk. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions.

2. Access and account

By agreeing to these Terms of service, you confirm that you are at least the age of majority in your state or province of residence. You are responsible for keeping your account details secure and for all activity under your account. We may refuse service to anyone for any lawful reason at any time.

3. Our products

• Most of our products are made to order and personalized. You are responsible for the accuracy of the text, names, spelling, capitalization, dates and images you submit.
• We produce what you submit, so please check your submission before ordering.
• You confirm that you own or have the necessary rights to any photo, image, logo, text or other content you send us, and that our use of it to produce your order does not infringe the rights of any third party, including copyright and personality rights.
• We may refuse to produce, and may cancel, any order containing content that is unlawful, infringing, hateful or sexually explicit, or that we cannot reproduce for technical reasons. If we cancel for these reasons, we refund the order in full.
• Product images and colours on the site are illustrative. Screen displays vary, and the final printed result may differ slightly in colour, placement and finish from what you see on screen.

4. Prices, payment and taxes

Prices are shown in EUR for customers in Germany and the European Union; for all other destinations, prices are converted to the currency shown at checkout. We may change prices without notice. We accept payment by Visa, Mastercard, American Express, Discover and PayPal. Payment is processed securely through Shopify. Sales tax or VAT, where applicable, is calculated at checkout.

5. Shipping and delivery

Delivery times are estimates and are not guaranteed. Production and delivery times are set out in our Shipping policy, which forms part of these Terms.

6. Returns, cancellations and refunds

Returns, cancellations and refunds are governed by our Refund policy, which forms part of these Terms.

7. Intellectual property

All content on this site (text, graphics, logos, images, designs) is our property or used with permission and is protected by copyright. You may not reproduce, copy, sell or exploit any part of the Service without our written permission. Personalized content you submit remains yours; you grant us a licence to use it solely to produce and deliver your order.

8. Prohibited uses

You may not use the site to upload or transmit unlawful, infringing or malicious content, to violate any law, to infringe our or others' intellectual property, or to interfere with the security of the site.

9. Disclaimer and limitation of liability

We do not guarantee that the Service will be uninterrupted, timely, secure or error-free. To the maximum extent permitted by law, our total liability arising from any order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for faulty goods and your mandatory statutory consumer rights.

10. Governing law and disputes

Nothing in these Terms affects the mandatory consumer protection rights you have under the laws of your country of residence. Please contact us if you have a dispute and we will work with you to resolve it.

11. Changes to these Terms

We may update these Terms from time to time. The version in force is the one published on this page at the time of your order.
